OFFICIAL STATION CONTEST RULES

OFFICIAL RULES FOR CUMULUS RADIO STATION CONTESTS & SWEEPSTAKES
A complete copy of these rules can be obtained at the offices of any radio
station owned
and/or operated by Cumulus Radio Corp.(“Sponsor”) during normal
business hours
Monday through Friday or by sending a self-addressed, stamped envelope to
3280 Peachtree Road, Suite 2300, Atlanta, GA 30305, Attn: Legal Department.
Sponsor will conduct all Cumulus radio station contests and sweepstakes
(“Contests” and “Sweepstakes”), including on-air contests,
online and text-based sweepstakes, and contests and sweepstakes conducted
through a Cumulus radio station’s social media accounts (e.g., Facebook,
Twitter, etc.), substantially as described in these rules, and by participating,
each participant agrees as follows:
1. NO PURCHASE IS NECESSARY. VOID WHERE PROHIBITED. ALL FEDERAL, STATE,
AND LOCAL REGULATIONS APPLY.
2. Eligibility. Unless otherwise specified, all Contests and Sweepstakes
are open only to legal U.S. residents age eighteen (18) years or older at
the time of entry with a valid Social Security number and who reside in
the Cumulus radio station’s Designated Market Area (“DMA”) as
defined by Nielsen Audio. Void where prohibited by law. Individuals age
13 to 17 may be eligible to participate in Contests and Sweepstakes with
the approval of a parent or legal guardian, provided that the parent or
legal guardian is a legal U.S. resident at least 18 years of age at the
time of entry with a valid Social Security number and resides in the Cumulus
radio station’s listening area. Unless otherwise specified, employees of
Cumulus Media Holdings Inc., its parent company, affiliates, related entities
and subsidiaries, promotional sponsors, prize providers, advertising agencies,
other radio stations serving the Cumulus radio station’s DMA, and the immediate
family members and household members of all such employees are not eligible
to participate. The term “immediate family members” includes spouses,
parents and step-parents, siblings and step-siblings, and children and stepchildren.
The term “household members” refers to people who share the same
residence at least three (3) months out of the year. An individual may win
a Contest or Sweepstakes only once per six (6) month period unless otherwise
specifically stated. Contests and Sweepstakes are subject to all applicable
federal, state and local laws and regulations. Participation constitutes
entrant’s full and unconditional agreement to these Official Rules and Sponsor’s
decisions, which are final and binding in all matters related to the Contest
or Sweepstake. Winning a prize is contingent upon fulfilling all requirements
set forth herein.
3. Contest or Sweepstakes Period. The Contest or Sweepstake will begin and
end at the times specified by Sponsor. Sponsor’s computer is the official
time keeping device for all Contests and Sweepstakes.
4. How to Enter. Entry methods for Contest and Sweepstakes will be specified
by Sponsor and entries must be received during the Contest or Sweepstakes
Period to be eligible. Use of any automated system to participate is prohibited
and will result in disqualification. Sponsor shall not be responsible for
lost, late, incomplete, invalid, unintelligible, inappropriate or misdirected
entries, all of which will be disqualified. In the event of a dispute as
to any entry, the authorized account holder of the email address or telephone
number used to enter will be deemed to be the participant. The “authorized
account holder” is the natural person assigned the telephone number
by the wireless carrier or an email address by an Internet access provider,
online service provider or other organization responsible for assigning
email addresses for the domain associated with the submitted address. Potential
winner may be required to show proof of being the authorized account holder.
All entries become the sole and exclusive property of Sponsor and will not
be returned. Sponsor reserves the right to contact entrants and all other
individuals whose email address is submitted as part of a Contest or sweepstakes.Time Delay Between Over-the-Air Analog Signal and Other Signal Delivery:
Due to the time delay that exists between a Cumulus radio station’s analog
over-the-air signal and its online webcast, listeners who listen to a Cumulus
radio station online may hear Contest or Sweepstakes information or a cue
to call later than listeners listening to the station’s analog over-the-air
signal. As a result, the odds of an online listener winning a Contest Sweepstakes
may be diminished
5. Winner Selection. Contest and Sweepstakes winners will be determined
according to the method specified by Sponsor at Sponsor’s sole and exclusive
discretion. The winning entrant will be contacted using the email address
and/or telephone number provided with the entry and may be awarded the prize
(subject to verification of eligibility and compliance with the terms of
these rules or the specific Contest or Sweepstakes rules). Sponsor’s decisions
as to the administration and operation of Contests and Sweepstakes and the
selection of potential winners is final and binding in all matters related
to the Contest or Sweepstakes. Failure to respond to the initial verification
contact within three (3) days of notification will result in disqualification.
6. Verification of Potential Winner. POTENTIAL CONTEST AND SWEEPSTAKES WINNERS
ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING
IN ALL MATTERS RELATED TO THE CONTEST OR SWEEPSTAKES. The potential winner
must continue to comply with all terms and conditions of these Official
Rules and/or the Office Rules of the specific Contest or Sweepstakes, and
winning is contingent upon fulfilling all requirements. The potential winner
will be notified by email and/or telephone call, after the date of random
drawing. The potential winner will be required to sign and return to sponsor,
within three (3) days of the date notice is sent, an affidavit of eligibility
and a liability/publicity release (except where prohibited) in order to
claim his/her prize, if applicable. A winner who returns the affidavit of
eligibility and liability/publicity release within the required time period
will be deemed to have accepted the prize and thereafter will not be permitted
to rescind their acceptance of the prize and/or return the prize. If a potential
winner cannot be contacted, fails to sign and return the affidavit of eligibility
and/or the liability/publicity release within the required time period (if
applicable), or if the prize or prize notification is returned as undeliverable,
potential winner forfeits prize. In the event that the potential winner
of a contest or sweepstakes prize is disqualified for any reason, Sponsor
may award the applicable prize to an alternate winner by random drawing
from among all remaining eligible entries.
7. Prizes. Contest and Sweepstakes prizes will be as specified by Sponsor.
Winner is responsible for all taxes associated with prize receipt and/or
use. Odds of winning a Contest or Sweepstakes prize depend on a number of
factors, including but not limited to the number of eligible entries received
by Sponsor during the Contest or Sweepstakes Period and the number of listeners
participating at any given time. Sponsor reserves the right to substitute
any listed prize for one of equal or greater value for any reason. For prizes
that involve travel, unless otherwise specified, trips must be taken within
the stated time periods or will be forfeited, winner and guest must travel
on the same itinerary, and winner’s guest must be eighteen (18) years of
age or older. Trips are non-transferable and no substitution will be made
except as provided at the Sponsor’s sole discretion.
8. Entry Conditions and Release.
By entering a Contest or Sweepstakes, each participant agrees to: (a) comply
with and be bound by these Official Rules, the Office Rules of the specific
Contest or Sweepstakes, and the decisions of Sponsor, which are binding
and final in all matters relating to any Contest or Sweepstakes; (b) release
and hold harmless Sponsor, Cumulus Media Inc., and its subsidiaries, related
and affiliated companies, participating sponsors, the prize suppliers and
any other organizations responsible for sponsoring, fulfilling, administering,
advertising or promoting the Contest or Sweepstakes, and each of their respective
past and present officers, directors, employees, agents and representatives
(collectively, the “Released Parties”) from and against any and
all claims, expenses, and liability, including but not limited to negligence
and damages of any kind to persons and property, including but not limited
to invasion of privacy (under appropriation, intrusion, public disclosure
of private facts, false light in the public eye or other legal theory),
defamation, slander, libel, violation of right of publicity, infringement
of trademark, copyright or other intellectual property rights, property
damage, or death or personal injury arising out of or relating to a participant’s
entry, creation of an entry or submission of an entry, participation in
a Contest or Sweepstakes, acceptance or use or misuse of prize (including
any travel or activity related thereto) and/or the broadcast, exploitation
or use of entry; and (c) indemnify, defend and hold harmless the Released
Parties from and against any and all claims, expenses, and liabilities (including
reasonable attorneys’ fees) arising out of or relating to an entrant’s participation
in the Contest or Sweepstakes and/or entrant’s acceptance, use, non-use
or misuse of the prize.
9. Publicity. Except where prohibited, participation in a Contest or Sweepstakes
constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s
name, likeness, photograph, voice, opinions and/or hometown and state for
promotional purposes in any media, worldwide, without further payment or
consideration, unless otherwise prohibited by law.
10. Taxes. All State, Local, Federal and or other taxes, duties, tariffs,
title fees, licensing fees, or other fees for prizes awarded in any Contest
or Sweepstakes become the sole responsibility of the winner. All those who
win a prize or prizes valued $600 or more in any given year will be issued
an IRS Form 1099 to report their winnings.
11. General Conditions. Sponsor reserves the right to cancel, suspend and/or
modify any Contest or Sweepstakes, or any part of it, if any fraud, technical
failures or any other factor beyond Sponsor’s reasonable control impairs
the integrity or proper functioning of the Contest or Sweepstakes, as determined
by Sponsor in its sole discretion. Sponsor reserves the right in its sole
discretion to disqualify any individual it finds to be tampering with the
entry process or the operation of the Contest or Sweepstakes or to be acting
in violation of these Official Rules or any other promotion or in an unsportsmanlike
or disruptive manner. Any attempt by any person to deliberately undermine
the legitimate operation of a Contest or Sweepstakes may be a violation
of criminal and civil law, and, should such an attempt be made, Sponsor
reserves the right to seek damages from any such person to the fullest extent
permitted by law. Sponsor’s failure to enforce any term of these Official
Rules shall not constitute a waiver of that provision.
12. Limitations of Liability. The Released Parties are not responsible for:
(1) any incorrect or inaccurate information, whether caused by entrants,
printing errors or by any of the equipment or programming associated with
or utilized in the Contest or Sweepstakes; (2) technical failures of any
kind, including but not limited to malfunctions, interruptions, or disconnections
in phone lines or network hardware or software; (3) unauthorized human intervention
in any part of the entry process or the Contest or Sweepstakes; (4) technical
or human error which may occur in the administration of the Contest or Sweepstakes
or the processing of entries; or (5) any injury or damage to persons or
property which may be caused, directly or indirectly, in whole or in part,
from entrant’s participation in the Contest or Sweepstakes or receipt or
use, non-use or misuse of any prize. If for any reason an entrant’s entry
is confirmed to have been erroneously deleted, lost, or otherwise destroyed
or corrupted, entrant’s sole remedy is another entry in the Contest or Sweepstakes,
provided that if it is not possible to award another entry due to discontinuance
or completion of the Contest or Sweepstakes, or any part of it, for any
reason, Sponsor, at its discretion, may elect to hold a random drawing from
among all eligible entries received up to the date of discontinuance for
any or all of the prizes offered herein. No more than the stated number
of prizes will be awarded. In event that production, technical, programming
or any other reason causes more than stated number of prizes as set forth
in these Official Rules to be available or claimed, Sponsor reserves the
right to award only the stated number of prizes by a random drawing among
all legitimate, unawarded, eligible prize claims.
13. Disputes. Entrant agrees that: (i) any and all disputes, claims and
causes of action arising out of or connected with a Contest or Sweepstakes,
or any prizes awarded, other than those concerning the administration of
the Contest or Sweepstakes or the determination of the winner, shall be
resolved individually, without resort to any form of class action; (ii)
any and all disputes, claims and causes of action arising out of or connected
with a Contest or Sweepstakes, or any prizes awarded, shall be resolved
exclusively by the United States District Court or the appropriate state
court located in the entrant’s Cumulus radio station’s listening area; (iii)
any and all claims, judgments and awards shall be limited to actual out-of-pocket
costs incurred, including costs associated with entering a Contest or Sweepstakes,
but in no event attorneys’ fees; and (iv) under no circumstances will entrant
be permitted to obtain awards for, and entrant hereby waives all rights
to claim punitive, incidental and consequential damages and any other damages,
other than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT
ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL
DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning
the construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of entrant and Sponsor in connection
with the Contest or Sweepstakes, shall be governed by, and construed in
accordance with, the laws of the state in which the entrant’s Cumulus radio
station is located, without giving effect to any choice of law or conflict
of law rules (whether of the state in which the entrant’s Cumulus radio
station is located or any other jurisdiction), which would cause the application
of the laws of any jurisdiction other than the state in which the entrant’s
Cumulus radio station is located.
14. Entrant’s Personal Information. Information collected from entrants
is subject to Sponsor’s Privacy Policy, which is available on every Cumulus
radio station’s website under the “Privacy Policy” link. All entry
blanks, forms, devices, and materials gathered during the course of entry,
as well as all information contained on or within, shall become the sole
property of Sponsor to be used, disposed of or destroyed in its sole discretion.
Sponsor is not responsible for any incorrect or inaccurate information entered
by website users, and assumes no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission, communications
line failure, theft or destruction or unauthorized access to a Cumulus radio
station website.
15. Sweepstakes Results. A winners list may be obtained thirty (30) days
after the conclusion of a Contest or Sweepstakes by sending a self-addressed
stamped envelope to the Sweepstakes Sponsor identified below.

entry process or the operation of the Contest or Sweepstakes or to be acting
in violation of these Official Rules or any other promotion or in an unsportsmanlike
or disruptive manner. Any attempt by any person to deliberately undermine
the legitimate operation of a Contest or Sweepstakes may be a violation
of criminal and civil law, and, should such an attempt be made, Sponsor
reserves the right to seek damages from any such person to the fullest extent
permitted by law. Sponsor’s failure to enforce any term of these Official
Rules shall not constitute a waiver of that provision.
12. Limitations of Liability. The Released Parties are not responsible for:
(1) any incorrect or inaccurate information, whether caused by entrants,
printing errors or by any of the equipment or programming associated with
or utilized in the Contest or Sweepstakes; (2) technical failures of any
kind, including but not limited to malfunctions, interruptions, or disconnections
in phone lines or network hardware or software; (3) unauthorized human intervention
in any part of the entry process or the Contest or Sweepstakes; (4) technical
or human error which may occur in the administration of the Contest or Sweepstakes
or the processing of entries; or (5) any injury or damage to persons or
property which may be caused, directly or indirectly, in whole or in part,
from entrant’s participation in the Contest or Sweepstakes or receipt or
use, non-use or misuse of any prize. If for any reason an entrant’s entry
is confirmed to have been erroneously deleted, lost, or otherwise destroyed
or corrupted, entrant’s sole remedy is another entry in the Contest or Sweepstakes,
provided that if it is not possible to award another entry due to discontinuance
or completion of the Contest or Sweepstakes, or any part of it, for any
reason, Sponsor, at its discretion, may elect to hold a random drawing from
among all eligible entries received up to the date of discontinuance for
any or all of the prizes offered herein. No more than the stated number
of prizes will be awarded. In event that production, technical, programming
or any other reason causes more than stated number of prizes as set forth
in these Official Rules to be available or claimed, Sponsor reserves the
right to award only the stated number of prizes by a random drawing among
all legitimate, unawarded, eligible prize claims.
13. Disputes. Entrant agrees that: (i) any and all disputes, claims and
causes of action arising out of or connected with a Contest or Sweepstakes,
or any prizes awarded, other than those concerning the administration of
the Contest or Sweepstakes or the determination of the winner, shall be
resolved individually, without resort to any form of class action; (ii)
any and all disputes, claims and causes of action arising out of or connected
with a Contest or Sweepstakes, or any prizes awarded, shall be resolved
exclusively by the United States District Court or the appropriate state
court located in the entrant’s Cumulus radio station’s listening area; (iii)
any and all claims, judgments and awards shall be limited to actual out-of-pocket
costs incurred, including costs associated with entering a Contest or Sweepstakes,
but in no event attorneys’ fees; and (iv) under no circumstances will entrant
be permitted to obtain awards for, and entrant hereby waives all rights
to claim punitive, incidental and consequential damages and any other damages,
other than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT
ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL
DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning
the construction, validity, interpretation and enforceability of these Official
Rules, or the rights and obligations of entrant and Sponsor in connection
with the Contest or Sweepstakes, shall be governed by, and construed in
accordance with, the laws of the state in which the entrant’s Cumulus radio
station is located, without giving effect to any choice of law or conflict
of law rules (whether of the state in which the entrant’s Cumulus radio
station is located or any other jurisdiction), which would cause the application
of the laws of any jurisdiction other than the state in which the entrant’s
Cumulus radio station is located.
14. Entrant’s Personal Information. Information collected from entrants
is subject to Sponsor’s Privacy Policy, which is available on every Cumulus
radio station’s website under the “Privacy Policy” link. All entry
blanks, forms, devices, and materials gathered during the course of entry,
as well as all information contained on or within, shall become the sole
property of Sponsor to be used, disposed of or destroyed in its sole discretion.
Sponsor is not responsible for any incorrect or inaccurate information entered
by website users, and assumes no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission, communications
line failure, theft or destruction or unauthorized access to a Cumulus radio
station website.
15. Sweepstakes Results. A winners list may be obtained thirty (30) days
after the conclusion of a Contest or Sweepstakes by sending a self-addressed
stamped envelope to the Sweepstakes Sponsor identified below.

WXSM’s “FULLY LOADED COMEDY FESTIVAL” Contest
Official Rules

A complete copy of these rules can be obtained by contacting the offices of radio station WXSM  (“Station”), owned and operated by Cumulus Radio LLC located at 162 Free Hill Road, Gray, TN 37615, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to WXSM, P.O. Box 8668, Gray TN 37615.

The Station will conduct the WXSM “FULLY LOADED COMEDY FESTIVAL” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

 

  1. No purchase is necessary to enter or win. A purchase will not increase your chance of winning.   Void where prohibited.  All federal, state, and local regulations apply.

Eligibility.  This Contest is open only to legal U.S. residents, excluding Florida and New York residents, age twenty-one (21) years or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”) as defined by Nielsen Audio, who have not won a prize from the Station in the last thirty (30) days or a prize valued at $500 or more in the last six (6) months and whose immediate family members or household members have not won a prize from the Station in the last thirty (30) days or a prize valued at $500 or more in the last six (6) months. Void where prohibited by law.  Employees of Cumulus Radio LLC, its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Station’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

  1. Contest Period. The Contest entry period will begin at 6:01 a.m. ET on June 20, 2022 and will run weekdays from 6:01 a.m. ET through 5:59 pm ET through 5:59 p.m. ET on June 22, 2022 (the “Contest Period”).  The Station’s computer is the official time keeping device for this Contest.

 

  1. How to Enter/Win.  

(i) On-AirListen to the Station weekdays from 6:01 a.m. ET to 10:00 a.m. ET or 3:01 p.m. to 5:59 p.m. ET during the Contest Period and listen for the “cue-to-call sounder.”  When the Station plays the “cue-to-call” sounder, listeners should call the Station at 423.477.1064.  Caller ten (10) to the Station, as determined by Station in its sole discretion, will be a potential winner of a Qualifying Prize (as defined below) and be entered in a random drawing for the Grand Prize (as defined below).  Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering and/or winning this Contest on-air may be diminished.

  1. Winner Selection. Each weekday during the Contest Period, June 20, 2022 to June 21, 2022, Station will play the cue to call one ­­ (1) time between 6:01 a.m. to 10:00 a.m.ET and 3:01 p.m. to 5:59 p.m. ET. On June 22, 2022, Station will play the cue to call two ­­ (2) times between 6:01 a.m. to 10:00 a.m. ET. Caller ten (10) as announced by Station will win a Prize (as described below). The winning entrants will be notified during the call and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the Qualifying Prize winners are final and binding in all matters related to the Contest. Failure to claim prize within thirty (30) days of winning will result in disqualification and forfeiture of the prize.

  2. Verification of Potential Winner. THE ELIGIBILITY OF ALL POTENTIAL CONTEST WINNERS IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be required to sign an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable. A winner who signs the affidavit of eligibility and the liability/publicity release will be deemed to have accepted the contest prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign the affidavit of eligibility and the liability/publicity release within the required time period (if applicable), or the prize or prize notification is returned as undeliverable, the potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. 

  3. Up to seven (7) Prizes will be awarded in this Contest.  Each Prize consists of two (2) digital grandstand seating tickets to the Fully Loaded Comedy Festival, held on June 24, 2022, at Bristol Motor Speedway, 151 Speedway Boulevard, Bristol, TN 37620.

 

  1. The approximate retail value (“ARV”) of each prize is SEVENTY-FIVE DOLLARS ($75.00).

 

 

TOTAL ARV OF ALL CONTEST PRIZES IS: FIVE HUNDRED TWENTY FIVE DOLLARS ($525.00)

 

  1. Tickets will be digitally delivered to winner’s email address. Winner is responsible for all taxes associated with prize receipt and/or use. Odds of winning a Prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time.  

For entry to the prize event, each event attendee may be required to show valid proof of vaccination against the COVID-19 virus and/or valid proof of a negative test for the COVID-19 virus within 72 hours (or such other time as the event organizers require) prior to the event.

 

 

There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion and to the extent permitted by law, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses.  Any tickets and/or gift certificates/cards awarded as part of a prize will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets or gift certificates/cards.

  2. Except where prohibited, participation in the Contest constitutes winner’s consent to use by the Station and its agent of winner’s name, likeness, photograph, voice, opinions and/or biographical information (including hometown and state) for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.

  3. All State, Local, Federal and/or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.

  4. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Taxes.  All State, Local, Federal and/or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.

  4. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or acting in an unsportsmanlike or disruptive manner. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Station, entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. No more than the stated number of prizes will be awarded.   6. Disputes. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. A complete copy of these rules can be obtained by contacting the offices of radio station WQUT (“Station”), owned and operated by Cumulus Radio LLC located at 162 Free Hill Road, Gray, TN 37615, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to WQUT, P.O. Box 8668, Gray TN 37615.

The Station will conduct the WXSM “BRISTOL RACIN’ WEEKEND FOOD CITY DIRT RACE” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

 

  1. No purchase is necessary to enter or win.  A purchase will not increase your chance of winning.   Void where prohibited.  All federal, state, and local regulations apply.

Eligibility.  This Contest is open only to legal U.S. residents, excluding Florida and New York residents, age twenty-one (21) years or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”) as defined by Nielsen Audio, who have not won a prize from the Station in the last thirty (30) days or a prize valued at $500 or more in the last six (6) months and whose immediate family members or household members have not won a prize from the Station in the last thirty (30) days or a prize valued at $500 or more in the last six (6) months. Void where prohibited by law.  Employees of Cumulus Radio LLC, its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Station’s decisions, which are final and binding in all matters related to the Contest.   1. Contest Period.  The Contest entry period will begin at 6:01 a.m. ET on March 28, 2022 and will run weekdays from 6:01 a.m. ET through 5:59 pm ET through 5:59 p.m. ET on April 8, 2022 (the “Contest Period”).  The Station’s computer is the official time keeping device for this Contest.

 

  1. How to Enter/Win.   

(i) On-AirListen to the Station weekdays from 6:01 a.m. ET to 9:59 a.m. or 3:01 p.m. to 6:00 p.m. ET during the Contest Period and listen for the “cue-to-call sounder.”  When the Station plays the “cue-to-call” sounder, listeners should call the Station at 423.477.1064.  Caller ten (10) to the Station, as determined by Station in its sole discretion, will be a potential winner of a Qualifying Prize (as defined below) and be entered in a random drawing for the Grand Prize (as defined below).  Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering and/or winning this Contest on-air may be diminished.

  1. Winner Selection.  Each weekday during the Contest Period, Station will play the cue to call one ­­ (1) time between 6:01 a.m. ET to 9:59 a.m. and 3:01 p.m. to 6:00 p.m. ET. Caller ten (10) as announced by Station will win a Prize. The winning entrants will be notified during the call and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the Qualifying Prize winners are final and binding in all matters related to the Contest. Failure to claim prize within thirty (30) days of winning will result in disqualification and forfeiture of the prize.

 

  1. Verification of Potential Winner. THE ELIGIBILITY OF ALL POTENTIAL CONTEST WINNERS IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be required to sign an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable.  A winner who signs the affidavit of eligibility and the liability/publicity release will be deemed to have accepted the contest prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign the affidavit of eligibility and the liability/publicity release within the required time period (if applicable), or the prize or prize notification is returned as undeliverable, the potential winner forfeits prize.   1. Up to twenty (20) Prizes will be awarded in this Contest.  Each Prize consists of two (2) digital grandstand seating tickets to the Food City 2022 Dirt Race event, held on April 17, 2022, at Bristol Motor Speedway, 151 Speedway Boulevard, Bristol, TN 37620.

 

 

  1. The approximate retail value (“ARV”) of each qualifying prize is ONE HUNDRED SEVENTY DOLLARS ($170.00).

 

 

TOTAL ARV OF ALL CONTEST PRIZES IS: THREE THOUSAND FOUR HUNDRED DOLLARS ($3,400.00)

 

  1. Tickets will be digitally delivered to winner’s email address. Winner is responsible for all taxes associated with prize receipt and/or use. Odds of winning a Prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time. 

For entry to the prize event, each event attendee may be required to show valid proof of vaccination against the COVID-19 virus and/or valid proof of a negative test for the COVID-19 virus within 72 hours (or such other time as the event organizers require) prior to the event.

The locations, dates, and times of the remote broadcasts will be posted and updated on Stations’ websites www.wqut/com/race-for-the-vaccine, www.1049nashicon.com/race-for-the-vaccine, www.wjcw.com/race-for-the-vaccine, and www.640wxsm.com/race-for-the-vaccine at least three (3) days prior to each remote broadcast.

  • Online: If you have already received the complete COVID-19 vaccine, go to wqut/com/race-for-the-vaccine, www.1049nashicon.com/race-for-the-vaccine, www.wjcw.com/race-for-the-vaccine, or www.640wxsm.com/race-for-the-vaccine and fill out an entry form.  All entries must be received by 11:59pm CT on June 30, 2021 to be eligible to win. Multiple participants are not permitted to share the same email address. Any attempt by any participant to submit more than one (1) entry per day by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entry and the participant may be disqualified.  Use of any automated system to participate is prohibited and will result in disqualification. Stations are not responsible for lost, late, incomplete, invalid, unintelligible, inappropriate or misdirected registrations, all of which will be disqualified.  In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Station, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Station, Cumulus Radio LLC, and its subsidiaries, related and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize.

  2. Except where prohibited, participation in the Contest constitutes winner’s consent to use by the Station and its agent of winner’s name, likeness, photograph, voice, opinions and/or biographical information (including hometown and state) for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.

  3. All State, Local, Federal and/or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.

  4. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

  5. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Station, entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. No more than the stated number of prizes will be awarded. In event that a production, technical, programming or other error causes more than stated number of prizes as set forth in these Official Rules to be claimed, Station reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

  6. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.   7. Entrant’s Personal Information. Information collected from entrants is subject to Station’s Privacy Policy, which is available on the Station’s website under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained therein, shall become the sole property of Station to be used, disposed of or destroyed in its sole discretion. Station is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to Station’s website.

A complete copy of these rules can be obtained by contacting radio station WXSM (“Station”), owned and operated by Cumulus Radio LLC located at 162 Free Hill Road, Gray, TN 37615, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to WXSM, P.O. Box 8668, Gray TN 37615.

The Station will conduct the WXSM Bracket Challenge Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

 

  1. No purchase is necessary to enter or win. A purchase will not increase your chance of winning.   Void where prohibited.  All federal, state, and local regulations apply.

Eligibility.  This Contest is open only to legal U.S. residents, excluding Florida and New York residents, age eighteen (18) years or older at the time of entry with a valid Social Security number and who own their primary residence where the Grand Prize (as defined below) will be installed,  reside in the Station’s Designated Market Area (“DMA”) as defined by Nielsen Audio, who have not won a prize from the Station in the last thirty (30) days or a prize valued at $500 or more in the last six (6) months and whose immediate family members or household members have not won a prize from the Station in the last thirty (30) days or a prize valued at $500 or more in the six (6) months. Void where prohibited by law.  Employees of Cumulus Radio LLC, its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Station’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

  1. Contest Period. The Contest will begin at 12:01 am ET on March 14, 2021 and will run through 9:00 am ET on April 5, 2021 (the “Contest Period”). The Station’s computer is the official time keeping device for this Contest.
  2. How to Enter/Win.  

Online: Visit Station’s website, www.640wxsm.com, navigate to the WXSM Bracket Challenge graphic and link to the  Men’s College Basketball Tournament bracket page, and complete an entry which includes completing a bracket  for the men’s college basketball  tournament. All entries must be received by 12:00 Noon ET on March 20, 2021 to be eligible for the Grand Prize (as defined below). Limit one entry per person. Multiple participants are not permitted to share the same email address. Any attempt by any participant to submit more than one entry per day by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entry and the participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Station is not responsible for lost, late, incomplete, invalid, unintelligible, inappropriate or misdirected registrations, all of which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. The “authorized account holder” is the natural person assigned the telephone number by the wireless carrier or an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Station and will not be returned. Station reserves the right to contact entrants and all other individuals whose email address is submitted as part of this promotion. No mail-in entries will be accepted.

  1. Winner Selection. At the conclusion of the men’s college basketball tournament on or around 11:00pm ET on April 5, 2021, the entry that has earned the most points according to the bracket scoring rules will be determined the winner. Brackets will be scored according to the following:

Round 2 (16 games)/Mar. 21-22 — 2 pts. — 4 pts.

Round 4 (4 games)/ Mar. 28-29 — 4 pts. — 8 pts.

Round 5 (2 games)/ Apr. 3 — 5 pts. — 10 pts.

Round 6 (1 game)/Apr. 5 — 6 pts. — 12 pts.

Tiebreaker will be determined by the forecast of the final score, if necessary. For tiebreakers that involve forecasting a total game score, unless otherwise specified, the tiebreaker gets evaluated in this order: (1) exact total, (2) closest to total score (3) closest to total score without going over. The winning entrant will be contacted using the email address and/or telephone number provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules, including providing proof of home ownership).

Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification and forfeiture of the prize.

  1. Verification of Potential Winner. THE ELIGIBILITY OF ALL POTENTIAL CONTEST WINNERS IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be required to sign an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable. A winner who signs the affidavit of eligibility and the liability/publicity release will be deemed to have accepted the contest prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign the affidavit of eligibility and the liability/publicity release within the required time period (if applicable), or the prize or prize notification is returned as undeliverable, the potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.

 

 

  1. Grand Prize. One (1) Grand Prize will be awarded in this Contest. The Grand Prize is a basketball court approximately 25′ x 40′ for 1,000 square feet maximum with a 4″ compacted base and a 2″ compacted asphalt cap on the winner’s property, provided the property is level and allows access and ample space to install the court. Basketball goal and court striping is not included. Winner’s property must be located within a 50-mile radius of the main office of Fuller Paving Group at 3024 Brookside Drive in Kingsport, TN. ARV: Two Thousand Five Hundred
    Dollars ($2,500). Winner is responsible for all taxes associated with prize receipt and/or use. Odds of winning the Grand Prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time.

Should winner’s property be unsuitable for installation as determined by Fuller Paving Group, the Grand Pprize may be transferred or donated to a party that can accommodate the court.  There is no substitution,  or cash equivalent for prizes, except that the Station may, at its sole discretion and to the extent permitted by law, substitute prizes of comparable value or cash.
